Nicole Fulfree represents creditors' committees, individual creditors, post-confirmation fiduciaries, landlords, debtors, and institutional shareholders and investors in a variety of complex bankruptcy matters. Her extensive experience translates into a clear understanding of the right strategies for clients involved in any aspect of a restructuring. From litigating adversary proceedings and other contested matters to representing litigation claimants within both the Chapter 11 and Chapter 7 contexts, Nicole brings strategic judgment to bear in developing optimal solutions.
Nicole has represented official committees of unsecured creditors in several high profile Chapter 11 cases, including:
- Health retailer GNC Holdings, Inc. where the company was sold for $770 million (recognized by the Global M&A Network’s Turnaround Awards)
- Discount retailer Fred's, Inc., where after the creditors’ rejection of the debtors’ original plan, she led months of negotiations to achieve an amended plan acceptable to creditors)
- Iconic retailer Modell’s Sporting Goods, Inc. in the liquidation of all its stores after unprecedented challenges caused by COVID-19.
In addition, she served as counsel to a 26-member defense group comprised of state, local, union, and private funds in a $380 million fraudulent transfer action in the ASHINC Corp. Chapter 11 cases.
Nicole frequently publishes articles on insolvency issues in such publications as AIRA Journal, Business Law Today, CRF News, Corporate Counsel, and New Jersey Lawyer. She is also a regular speaker on Chapter 11 issues at bankruptcy conferences, credit group meetings, and webinars. Nicole has been recognized by the American Bankruptcy Institute’s 40 Under 40 program, which honors emerging leaders in the insolvency profession who are committed to the highest standards of achievement at work and in their communities.
Nicole is on the leadership team of Lowenstein’s Women’s Initiative Network (WIN), a grassroots program comprised of attorneys from across the firm’s practice areas, seniority levels, and offices that supports and empowers women to achieve professional and personal success. She has led efforts to support new women associates through mentoring and by providing a platform for women attorneys to discuss difficult topics ranging from mental health to pregnancy complications. She is also one of the original hosts of the firm’s podcast “Real Talk,” which engages women attorneys in open discussions on a wide range of issues.
Nicole’s pro bono work includes numerous Chapter 7 cases, an out-of-court restructuring for a nonprofit organization, and several matters defending victims of domestic abuse. Prior to joining the firm, Nicole clerked for the Hon. Donald H. Steckroth of the U.S. Bankruptcy Court for the District of New Jersey.
