Matthew Friedenberg litigates commercial disputes in state and federal court, as well as alternative dispute resolution forums. He represents leading private and public businesses in relation to their most important assets and sensitive commercial dealings.

Matthew frequently represents real estate operators and their capital providers, marquee luxury brands, and private equity firms and their portfolio companies, to whom he provides counsel on both pending and potential disputes.

Matthew has been recognized by Super Lawyers as one of New York City’s Rising Stars for commercial and real estate litigation every year since 2014.

  • Represent international luxury retailer in action to prevent termination by landlord of retailer’s long-standing lease at premiere international shopping destination, and in bringing related counterclaims against landlord for breach of contract and defamation
  • Served as first-chair trial counsel to owner of historic American sporting company in expedited bet-the-company litigation over company’s ownership composition; as part of representation, secured complete trial victory subsequently affirmed on appeal by state Supreme Court
  • Represented hedge fund in expedited dual-track state/federal litigation against public REITs to determine fund’s right as a shareholder to propose changes to REIT governance; as part of representation, following expedited discovery, successfully defended REIT’s motion to dismiss and for a preliminary injunction to block fund from exercising shareholder rights, driving favorable settlement as a result
  • Represented family office in litigation relating to the general partner of a healthcare real estate fund’s breach of fiduciary duties and mismanagement of a $75 million investment in a portfolio of nine senior living facilities; as part of the representation, succeeded after trial in placing the fund and its general partner under interim receivership, mitigating further harm to the investment and preserving the underlying assets, then later prevailing in the summary judgment phase on significant damages claims
  • Represented international hotel chain in dispute with owner of luxury hotel over attempts to terminate the chain’s hotel management agreement and retain million dollars in key money
  • Represented publicly traded department store chain in litigation and related appeals to enforce easement rights necessary to ensure viability of a two million square-foot distribution center representing a $300 million investment; as part of the representation, defeated opposing land trust’s motion to dismiss the easement claims on Strategic Lawsuits Against Public Participation (“SLAPP”) grounds, and obtained affirmance of denial at the intermediate appeals and state Supreme Court
