Gianfranco Finizio focuses his practice on bankruptcy and insolvency matters. He represents a diverse range of clients including official committees of unsecured creditors, indenture trustees, debtors, bank agents, and other major secured and unsecured creditors in complex Chapter 11 bankruptcy cases, out-of-court restructurings, and other distressed situations.

Gianfranco has extensive experience with representing parties in Chapter 11 cases in the pharmaceutical, healthcare, and retail industries, to name a few.

He frequently publishes articles on insolvency issues and presents at industry conferences, discussing emerging issues on bankruptcy-specific topics. Gianfranco was listed in the 2021, 2022 and 2023 editions of Chambers USA: America’s Leading Lawyers for Business in the area of Bankruptcy/Restructuring. Gianfranco was recognized in 2023 as a “Rising Star” by American Lawyer’s New York Law Journal.  He was also honored by the American Bankruptcy Institute (ABI) in 2022 as one of its "40 Under 40" Emerging Leaders for his Insolvency Practice.

Committed to pro bono work, Gianfranco provides legal services to children in need through KIND (Kids in Need of Defense), a nonprofit that offers legal counsel to unaccompanied refugees and immigrant children. He also volunteers for Immigrant ARC’s Friend of the Court program to assist pro se respondents in navigating the immigration court system.

  • Currently represent the Official Committee of Unsecured Creditors in Chapter 11 cases of domestic e-commerce parcel and cross-border logistics services provider, a former subsidiary of Pitney Bowes. In re DRF Logistics, LLC et al. (Bankr. S.D. Tex.)
  • Currently represent the Official Committee of Unsecured Creditors in Chapter 11 cases of restaurant group operating the Tender Greens and Tocaya restaurant brands. In re One Table Restaurant Brands, LLC et al. (Bankr. D. Del.)
  • Currently represent an ad hoc crossover group of convertible noteholders in the Chapter 11 cases of a developer, manufacturer, and marketer of personalized, precision intraoral medical devices with approximately $50 million of debt.  In re ProSomnus, Inc. et al. (Bankr. D. Del.)

The below transactions were completed before June 2024, prior to joining Lowenstein Sandler:

  • Represented the official committee of unsecured creditors in Chapter 11 case of clinical-stage biopharmaceutical company with approximately $50 million of unsecured debt. In re Humanigen, Inc. (Bankr. D. Del.).
  • Represented the first lien term loan agent in Chapter 11 cases of national medical group with over $5 billion in debt, making it one of the largest healthcare bankruptcy cases on record. In re Envision Healthcare Corporation (Bankr. S.D. Tex.).
  • Represented the official committee of unsecured creditors in Chapter 11 cases of developer, manufacturer, and distributor of pharmaceuticals with over $650 million in debt. In re Lannett Company, Inc. (Bankr. D. Del.).
  • Represented the indenture trustee for over $720 million in unsecured notes in Chapter 11 cases of one of the largest mall operators with over $3 billion in debt. In re Washington Prime Group Inc. (Bankr. S.D. Tex.).
  • Represented debtors in Chapter 7 cases of studio spin cycle company with approximately $37 million in secured debt. Immediately prior to the petition date, the debtors’ studio spin cycle business was comprised of 29 fitness studios in top markets across the United States. In re Flywheel Sports Parent, Inc. (Bankr. S.D.N.Y.).
